TERMS & CONDITIONS

01. NATURE OF DRACMA

DRACMA BY ANDAHUAR is an independent creative direction and experience design practice dedicated to the conception, curation and direction of distinctive experiences, creative projects and cultural collaborations.

DRACMA operates as a Haus of Direction. Its work may encompass creative direction, experience design and curation, artistic programming, production, travel coordination, reservations, visual projects, creative consulting, styling and collaborations with artists, brands, venues and selected providers.

DRACMA is not a traditional travel agency, advertising agency, branding agency or talent management agency. Each project is approached according to its specific nature and scope, with DRACMA providing the creative vision, narrative, curation and coordination necessary to bring the project together.

When engaged to direct an experience or creative project, DRACMA retains creative direction and overall curatorial authority over the project, while remaining open to collaboration with external creatives, studios, agencies, artists, brands and specialists when their involvement supports the project’s vision.

The specific nature and scope of each engagement will be established in the corresponding project proposal or written agreement.

02. INITIAL CONVERSATION

DRACMA requires an initial conversation with Alejandro Andahuar, Director of DRACMA before accepting or developing a project.

To request and confirm this initial video call, a scheduling and initial meeting fee of MXN $2,200 is required.

This fee formalizes the request, allows DRACMA to assess the seriousness and suitability of the prospective client and proposed project, and reserves the specific time allocated for the conversation.

The payment does not guarantee that DRACMA will accept or undertake a project and does not constitute a project deposit.

If DRACMA subsequently agrees to formally undertake the project, the full MXN $2,200 paid for the initial video call will be fully credited toward and deducted from the applicable Direction Fee.

The fee is otherwise non-refundable, except where otherwise required by applicable law.

03. PROJECTS & FEES

Each project will be governed by a specific written proposal or agreement establishing its scope, creative direction, deliverables, fees, payment schedule and applicable conditions.

DRACMA’s professional fees are separate from third-party costs and expenses associated with the development and execution of a project. These may include accommodation, transportation, venues, restaurants, artists, production, materials, permits, insurance, taxes and other services required for the project.

The specific financial and operational conditions of each project will be communicated directly to the client through the corresponding proposal or agreement.

04. FULL EXPERIENCE DIRECTION & CURATED NETWORK

DRACMA operates through a full experience direction model. When engaged to direct an experience, DRACMA assumes the creative direction and overall curation of the project in order to establish a unified narrative, atmosphere and methodology from conception through execution.

Every element of the experience is selected and articulated according to the narrative DRACMA intends to create. This may include artists, talent, chefs, venues, transportation providers, production teams, designers, cultural collaborators and other services required for the experience.

DRACMA works through a curated network of trusted providers, collaborators and contacts with whom it has previously established professional relationships. These individuals and teams understand DRACMA’s standards, creative process, communication style and methodology.

This network is an integral part of DRACMA’s creative and operational practice. The selection of each provider or collaborator is made according to the narrative, atmosphere, aesthetic and purpose of the experience, rather than as an isolated or interchangeable service.

DRACMA does not operate as a traditional booking or travel agency. Its role is to bring together the people, places, talent, services and resources necessary to construct a fully directed experience in which every element contributes to the same creative narrative.

Clients, guests, collaborators and third-party providers introduced through DRACMA agree not to circumvent DRACMA by directly soliciting, contracting, engaging or establishing independent commercial arrangements with providers, collaborators or contacts introduced by DRACMA in connection with a DRACMA project, without DRACMA’s prior written authorization.

Where appropriate, DRACMA may establish separate confidentiality, non-disclosure, non-circumvention, intellectual property or collaboration agreements with clients, collaborators and providers.

DRACMA recognizes and respects the authorship and contribution of every artist, creator, chef, designer, musician, photographer, performer and collaborator involved in an experience.

While DRACMA assumes the overall creative direction and curation of the experience, each artist and collaborator will receive appropriate credit and attribution for their contribution, according to the nature of their work and the agreements established for the project.

DRACMA approaches each experience with the spirit of an artistic company: a unified creative direction in which individual disciplines, talents and authorships come together to serve a common narrative, while remaining properly recognized as individual creative contributions.

05. CHANGES & CANCELLATIONS

Changes or cancellations may affect availability, timelines and costs.

The applicable cancellation, modification and refund conditions will be established in the specific project proposal or agreement and may also be subject to the policies of the relevant third-party providers.

Professional fees already earned and third-party expenses already paid or irrevocably committed on behalf of the client may be non-refundable.

06. CONFIDENTIALITY & INTELLECTUAL PROPERTY

DRACMA treats with discretion and confidentiality all information shared by its clients, collaborators and project partners.

DRACMA maintains confidentiality regarding personal information, project details, creative concepts, commercial information, contacts, professional relationships and any other information shared in connection with its work.

DRACMA retains all rights to its concepts, creative structures, narratives, proposals, itineraries, references, methodologies, visual materials, documents, systems, operational processes, supplier and collaborator contacts, networks, relationships and other original creative and operational materials, whether pre-existing or independently developed.

No concept, proposal, itinerary, narrative, design, reference, methodology, document, visual material, contact, network, relationship or other creative or operational material developed or provided by DRACMA may be copied, reproduced, distributed, disclosed, adapted, modified, published, commercialized, transferred or otherwise used, in whole or in part, without DRACMA’s prior written authorization, unless such use has been expressly granted in the applicable project agreement.

Payment for DRACMA’s services does not, by itself, transfer ownership of DRACMA’s intellectual property, proprietary methodology, operational systems, contacts or relationships, nor does it grant unrestricted rights to use or reproduce DRACMA’s materials.

Third-party materials remain subject to the rights and conditions of their respective owners or licensors.

DRACMA’s collaborators and selected providers may be required to enter into confidentiality, non-disclosure, non-circumvention, intellectual property and data protection agreements as part of their professional relationship with DRACMA.

07. AGE, SAFETY & ARCHIVE

DRACMA designs and directs experiences exclusively for individuals aged 21 and over.

Participants must comply with applicable laws, venue rules, provider policies and safety instructions throughout an experience.

Depending on the nature of a project, appropriate personal, medical or travel insurance may be required.

DRACMA maintains an internal archive of its projects and experiences for historical, creative, documentary and institutional purposes. Photographs, videos and audiovisual materials created in connection with DRACMA projects may form part of this archive.

Any public, editorial, promotional or commercial use of identifiable images or other personal materials will be subject to the appropriate authorization, agreement or legal basis required under applicable law.

08. GENERAL CONDITIONS

DRACMA provides its services according to the scope and conditions established for each project.

Specific project agreements may contain additional or different terms. Where applicable, the specific written agreement will govern the project with respect to the matters it expressly addresses.

Circumstances outside DRACMA’s reasonable control may affect the development of a project or experience. In such circumstances, DRACMA will communicate the situation and work toward an appropriate alternative whenever possible.

These Terms & Conditions are governed by and interpreted in accordance with the applicable laws of Mexico, without limiting any mandatory rights or protections that may apply.
